This forum examines the unauthorized practice of law.
Please thoroughly discuss each of the following:
1) Attorneys may not engage in the unauthorized practice of law. Discuss what constitutes the unauthorized practice of law.
2) Discuss what ethical issues are in this scenario:
Mike Marino is seeking a divorce in South Carolina. You are a practicing attorney in Massachusetts. You and Mike went to law school together 20 years ago. You have maintained a friendship over the years. You have also referred each other cases from time to time over the years. Mike calls you and asks for legal advice regarding alimony and child support. You tell him that he is going to get “cleaned out” by his wife unless he liquidates some of his assets and takes “pen to paper” to adjust some of his annual earnings with his firm. You also advise him that in South Carolina he will have to pay life time alimony and that it is “cheaper to just keep her”.
